Terms of Service
The terms that govern requesting, accepting a quote for, paying for, and completing a Waypoint appointment.

These Terms of Service ("Terms") govern your use of the Waypoint Notaries website and services provided by Waypoint Notaries LLC ("Waypoint," "we," "us," or "our").
By submitting a service request, accepting a quote, scheduling an appointment, making a payment, or otherwise using our services, you agree to these Terms.
If you are acting on behalf of a business, title company, law firm, lender, facility, or other organization, additional or separate commercial terms may apply.
Our Services
Waypoint provides mobile and remote notary-related services, including general notarizations, loan and real-estate signing appointments, hospital and senior-care visits, correctional-facility appointments, vehicle and title-related notarizations, estate-document signing appointments, and remote online notarization when available and legally appropriate.
Availability varies by location, appointment type, signer circumstances, document requirements, facility access, notary availability, and applicable law.
A request submitted through our website does not guarantee that Waypoint will accept or complete the appointment.
We Are Not a Law Firm
Waypoint Notaries LLC is not a law firm and does not provide legal advice.
Unless separately authorized by law, Waypoint and its notaries do not:
- select legal documents for you;
- determine what type of notarial certificate your document requires;
- draft or modify legal documents;
- advise you about the legal effect of a document;
- explain loan terms or advise you whether to complete a transaction; or
- determine whether a document is legally sufficient for your intended purpose.
You are responsible for obtaining legal, financial, tax, real-estate, or other professional advice when needed.
Your Responsibilities
You are responsible for providing accurate information when requesting service, including your contact information, appointment location, service needs, timing, signer count, and any relevant facility or access requirements.
You are also responsible for making sure that:
- the document to be notarized is available and substantially complete;
- the signer is willing to sign;
- the signer is able to communicate with the notary and participate in the notarization;
- acceptable identification is available when required;
- any required witnesses are available unless Waypoint has specifically agreed to provide or arrange them;
- you have permission to enter or conduct the appointment at the requested location; and
- any receiving institution will accept the type of notarization being requested.
Do not submit Social Security numbers, complete financial account numbers, copies of identification, medical records, passwords, or other unnecessary sensitive information through Waypoint's public request forms.
Notarization Is Not Guaranteed
A scheduled appointment does not guarantee that a notarization will be completed.
A Waypoint notary may decline or stop a notarization when required by law or professional obligation, including when the notary cannot reasonably verify identity, willingness, awareness, authority, document completeness, or another required element of the notarial act.
Waypoint does not guarantee that a court, government agency, lender, title company, financial institution, foreign authority, or other receiving party will accept a notarized document.
Quotes and Pricing
Waypoint may provide a quote before accepting or scheduling an appointment.
A quote may include:
- statutory notarial-act fees;
- travel and convenience charges;
- technology charges for remote online notarization where applicable;
- location or facility-related logistics;
- urgency or short-notice considerations;
- known parking, toll, access, or similar expenses; and
- other charges disclosed in the quote.
Under Ohio law, travel fees are separate from statutory notarial-act fees and are agreed upon before the notarial act.
Waypoint identifies statutory notarial-act fees separately from travel, convenience, technology, and other non-notarial service charges in its quotes and pricing records.
Quotes are valid only until the expiration time shown with the quote.
If the facts of the appointment materially change before acceptance or service — for example, the location, number of signers, service type, facility setting, timing, or scope — Waypoint may issue a revised quote.
Once a quote is accepted, Waypoint uses the accepted pricing record as the basis for that appointment unless an additional charge is separately authorized or a reconciliation is required because the service was not completed as originally expected.
Waypoint does not currently add a routine sales-tax charge to notary-service quotes. Any tax required by applicable law may be charged if legally necessary.
Payment
Waypoint may require payment before an appointment is scheduled, reserved, or performed.
Direct-customer online payments are generally processed through Square. Payment-card information is entered directly into Square's payment environment. Waypoint does not receive or store your full card number.
If online payment is unavailable or Waypoint authorizes another payment method, payment may be handled through another approved method.
A successful quote acceptance does not necessarily mean payment has been completed.
Waypoint may decline to perform or continue a service when required payment has not been received.
Cancellations and Refunds
Cancellation Before Travel Begins
When a prepaid direct-customer appointment is canceled before a Waypoint notary begins travel toward the appointment and no compensable service has been performed, the prepaid appointment amount is generally eligible for a full refund.
Waypoint's system processes qualifying refunds as the cancellation and job are operationally closed out.
A qualifying refund is not necessarily issued at the exact moment the cancellation button is pressed.
Cancellation After Travel Begins
Once travel toward an appointment has begun, the appointment is no longer eligible for an automatic full refund.
Waypoint will review the completed and uncompleted portions of the service.
Travel or convenience charges agreed to in your accepted quote may remain due, while unearned notarial-act charges or other unearned service components may be refunded as appropriate.
No-Sign, Partial Completion, and Unusual Outcomes
Appointments involving a no-sign, signer unavailability, identification problem, document issue, facility-access problem, partial completion, lender or title-company stop instruction, or other unusual outcome may require manual reconciliation.
Charges and refunds in these situations are determined according to the services actually performed and the circumstances of the appointment.
Waypoint does not automatically treat every unsuccessful notarization as either fully chargeable or fully refundable.
For remote online notarizations, Waypoint may charge a technology fee of up to $10 per online notarization session where permitted by Ohio law. That technology fee may remain chargeable even if the notarial act is not completed, including when the signer does not successfully complete the required identity-verification process.
Waypoint-Initiated Cancellations
If Waypoint cancels an appointment before travel or other compensable service begins, any prepaid amount will be refunded in full.
If Waypoint is unable to complete an appointment after service has begun because of a Waypoint operational issue, we will review the appointment and provide an appropriate refund, which may include a full refund depending on the circumstances.
Refund Processing
Refunds are generally returned through the original payment processor.
Once Waypoint submits a refund, the time required for the funds to appear in your account may depend on Square, your bank, or your card issuer.

Scheduling, Rescheduling, and Appointment Changes
Customer self-service scheduling, rescheduling, and cancellation may be subject to notice windows displayed in your customer management page.
Certain changes may require staff assistance, including changes that affect route pricing, appointment location, facility access, or the scope of service.
Appointment times are scheduled in good faith but may be affected by traffic, weather, facility procedures, earlier appointments, signer delays, emergencies, or other circumstances outside Waypoint's reasonable control.
We will make reasonable efforts to communicate material delays or changes.
Facilities and Restricted Locations
Hospitals, nursing facilities, assisted-living communities, correctional facilities, government buildings, and similar locations may impose access rules outside Waypoint's control.
You are responsible for confirming that the signer is available and that the location permits the requested appointment.
Waypoint does not guarantee admission to a facility, access to a signer, availability of facility staff as witnesses, parking availability, or completion within a particular facility's internal schedule.
Witnesses
Unless specifically arranged and included in your quote, you are responsible for providing any required witnesses.
Waypoint does not guarantee that facility staff, family members, attorneys, employees, or other persons at the appointment location will be legally eligible or available to serve as witnesses.
Remote Online Notarization
Waypoint may provide remote online notarization ("RON") when legally appropriate.
Waypoint currently uses Proof as the third-party platform for remote online notarization sessions.
Identity verification for RON is completed directly within the Proof platform. Do not send identification images, identity-verification materials, or similar credentials to Waypoint by email, public form, or another Waypoint intake channel.
Waypoint may receive or coordinate documents that need to be notarized as part of preparing the RON session, but identity verification remains within the authorized RON platform.
The Waypoint online notary must be physically located within the State of Ohio when the online notarial act occurs. A signer may be located elsewhere within the United States or, when the additional requirements of Ohio law are satisfied, outside the United States.
You are responsible for confirming that the person or organization receiving the document will accept remote online notarization.
Electronic Communications
By providing an email address, phone number, or other contact information and requesting service, you authorize Waypoint to contact you regarding your request, quote, payment, scheduling, appointment, service status, and reasonable service follow-up.
Waypoint may send transactional emails and may provide staff with suggested call or text scripts.
The Waypoint application does not currently operate an automated SMS marketing system.
You are responsible for maintaining access to the email address or telephone number you provide.
Secure Customer Links
Waypoint may provide secure or tokenized links that allow you to review a quote, schedule an appointment, or manage an existing request.
These links are intended for the recipient and may provide access to information about the corresponding request or appointment.
Do not forward a customer management link to someone who should not have access to your appointment information.
Waypoint may expire, revoke, or replace these links for security or operational reasons.
Third-Party Services
Waypoint relies on third-party providers to operate portions of the service, including payment processing, hosting, email delivery, mapping and routing, calendar services, and remote online notarization.
Your use of certain third-party features may also be subject to the provider's own terms and privacy practices.
Waypoint is not responsible for an independent third-party provider's outage, processing delay, or actions outside Waypoint's reasonable control.
Business and Organizational Customers
Organizations, title companies, lenders, law firms, signing services, facilities, and other commercial customers may have separate pricing, credit terms, invoicing arrangements, service agreements, or ordering procedures.
When a separate written agreement, account arrangement, purchase order, or other commercial term conflicts with these public Terms, the applicable commercial arrangement controls to the extent of that conflict.
Acceptable Use
You may not use Waypoint's services or systems to:
- commit fraud or impersonate another person;
- obtain a notarization through false information;
- interfere with the operation or security of the website;
- attempt to access another customer's private information;
- submit malicious code or automated abuse;
- use a customer capability link without authorization; or
- request that a Waypoint notary perform an unlawful act.
Waypoint may refuse or discontinue service when misuse, fraud, safety concerns, or unlawful activity is reasonably suspected.
Disclaimer of Warranties
Waypoint provides its website and services on an "as available" basis.
To the fullest extent permitted by law, Waypoint does not warrant that the website will always be uninterrupted or error-free, that every service request will be accepted, or that every notarized document will achieve the customer's intended legal or commercial result.
Nothing in these Terms limits obligations that cannot legally be disclaimed.
Limitation of Liability
To the fullest extent permitted by applicable law, Waypoint Notaries LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the website or services.
Except where applicable law requires otherwise, Waypoint's aggregate liability arising from a particular appointment or transaction will not exceed the amount paid to Waypoint for that appointment or transaction.
This limitation does not apply where it would be unlawful or where liability cannot legally be limited.
Governing Law and Venue
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.
Any legal action arising from these Terms or Waypoint's services must be brought in a state or federal court located in Ohio, unless applicable law requires otherwise.
These Terms do not require private arbitration.
Changes to These Terms
Waypoint may update these Terms as its services, technology, or legal obligations change.
The current version and effective date will be displayed on this page.
When appropriate, Waypoint may require customers to acknowledge updated Terms before submitting a new request, accepting a quote, or using certain services.
Severability
If any portion of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
